<h2>What are the rules surrouding voided claims under HISA?</h2>Claims are voided if the claimed Horse bled, dies, is euthanized, is vanned off the racetrack, or is later found to test positive for a prohibited substance.&nbsp;As a matter of procedure, all claimed horses go to the test barn for observation by a regulatory veterinarian. &nbsp;If a regulatory veterinarian determines within 1 hour of the race that the horse will be placed on the veterinarians’ list before the horse is released, the claim is void. Of Note: Claims will not be voided if the party claiming the horse elects on the claim slip to claim the horse “regardless of whether the regulatory veterinarian determines the horse will be placed on the veterinarians’ list as bled or unsound or the horse tests positive for a prohibited substance.” The claim is not voided unless the horse dies or is euthanized. &nbsp;For example, if a party claiming a horse is only interested in claiming a filly or mare as a broodmare, they may check this box, they will be able to keep the horse even if it is placed on the vet’s list. &nbsp;<h2>HISA Waiver Claiming Option</h2>An owner or trainer may opt to declare a horse ineligible to be claimed at time of entry into a claiming race provided it fits all three criteria:&nbsp;(a) The horse has not started in 120 days;(b) the horse’s last start must have been for a claiming price; and&nbsp;(c) the horse is entered for a claiming price equal or greater than the price it last started for. Part 3: Voided Claim Rules Under HISA

<h2>Transferring Records of a Claimed Horse</h2>Under HISA, a trainer consents to transfer (1) trainer treatment records and (2) veterinary examination and treatment records by entering horses in a claiming race. When a horse is claimed by a new trainer, the previous trainer must transfer trainer records to the new trainer within three days of transfer of the horse to the new trainer. &nbsp;Trainer records include the administration of any medication to a horse by a trainer or his or her designee, and excludes medications or procedures administered by a veterinarian or that veterinarian’s employees. The track’s claiming clerk will process the claim and change the responsible person and owner in the HISA system. Once this occurs, both Tom and Teresa will receive a message through HISA’s messaging system stating the process that must be followed for the transfer of trainer treatment records.Tom would be directed to a claim form on the HISA website that asks him to list all medical, therapeutic, and surgical treatments performed on the horse within the last sixty (60) days. Tom then must send this form to Teresa. This form cannot be sent within the HISA system, so Tom the Trainer would have to send Teresa his claim form via email or regular mail once he fills out the claim form on the HISA website. <h3>Welcome to Part 1 of On Track's Series: Trainer's Responsibilities Under HISA.&nbsp;</h3><h3>Today, we'll be focusing on record keeping and reporting obligations under HISA's rules.&nbsp;&nbsp;</h3>#1.&nbsp; Trainers are required to maintain a record of medical, therapeutic, and surgical treatments and procedures for every Covered Horse under his or her control. The records are not required to be submitted to HISA unless requested.&nbsp; Under HISA, treatment means:(1) the administration of any medication to a Horse by a Trainer or his or her designee; and(2) specifically excludes medications or procedures administered by a Veterinarian or that Veterinarian’s employees.This rule is focused on medical, therapeutic, and surgical treatment records, not training records.&nbsp;#2. Recordkeeping Requirements for Horses Shipping Into HISA Facilities to Race or Work Off the Vet’s List from Non-HISA FacilitiesIf a horse is not stabled at a facility under HISA’s jurisdiction (which would include facilities in Louisiana, Texas, and West Virginia) for the full 30 days prior to a race or workout for purposes of removal from the veterinarians’ list, the trainer shall obtain a record of medical, therapeutic, and surgical treatments and procedures for that horse for the previous 30 days.For example, a horse stabled at Sam Houston Race Park in Texas for a full 30 days prior to a race or workout for the purposes of getting off the vet’s list would be subject to this rule. This horse’s trainer would be required to obtain its medical, therapeutic, and surgical treatment and procedure records from the prior 30 days. Trainers are not required to submit these records unless HISA requests them, just collect them.→Note: For horses shipping in to race or work off the vet’s list after 60 days (layup) from a facility that is not under HISA’s jurisdiction, trainers must also obtain the last 30 days of rehabilitation activities (in addition to medical, therapeutic, and surgical treatments and procedures).&nbsp;The purpose of requiring this information is to help HISA understand what factors are associated with the high rate of catastrophic injuries that occur in horses soon after return from layup.
